Felony Bail Jumping Case Dismissed Within Days
October 2023 -- In a recent case handled by defense attorney Joanne Hicks, a client found themselves facing a charge for Bail Jumping in the First Degree. Bail Jumping in the First Degree is a serious C felony charge, with a possible maximum term of imprisonment of five years. However, after a prompt and thorough review of the procedural history of the case and the underlying matter, Joanne recognized that this charge raised significant concerns regarding due process and prosecutorial misconduct.
Within days of assignment on the case, Joanne communicated directly with the Maui Prosecutors and exposed the procedural defect and serious issue regarding prosecutorial misconduct. On the same day, the State dismissed its unjust charge by filing an Ex Parte Motion to Dismiss the case with prejudice. When a case is dismissed with prejudice (versus without prejudice), this means that the case can never be charged against the client again.
